California Proposition 8 Banning Gay Marriage: Overturned By Federal Judge In San Francisco

California's Proposition 8 banning gay marriage was overturned (opinion issued Wednesday at 1:45 pm) by a federal judge in San Francisco on the basis that the 14th Amendment was violated.

People will read this:

Wednesday afternoon, Chief U.S. District Judge Vaughn Walker ruled that the same-sex marriage ban violates the equal rights of gay and lesbian couples, a decision setting the stage for a promised appeal that appears destined for the U.S. Supreme Court.

What will be buried or avoided is this:
The ruling by U.S. District Judge Vaughn Walker, one of three openly gay federal judges in the country, gave opponents of the controversial Proposition 8 ballot a major victory.

Of course, Judge Walker had not one slightly biased bone in his body.

So here's the look of things to come. "It's going to happen whether you like it or not," said San Francisco Mayor Gavin Newsom.

By federal judicial fiat.

I am so sick of the judiciary over turning the will of the people. I believe that in every state where they have held a referendum on Gay Marriage the people have voted against it and in every instance a judge has overturned the vote. It is sickening.

What is sickening to me is that the majority of "the people" cannot come to terms with the fact that marriage is a binding contract between consenting adults and that the proper function of government is not to set the terms of contracts but rather to uphold them.

Wow...the government ignoring the will of the people again? Even if the overwhelming majority voted, the fed just stepped in and said to the people, "you don't know what you're doing or talking about. Only we know what's right in this land, NOT YOU." I'm going to miss my America very much. The same America I fought for and had many of my friends die for, is almost gone. God needs to intervene and make things right again. I feel sorry for America because we let her down. The shit had almost hitteth the fan.

It proves that voting DOESNT MATTER ANYMORE! The people will always be shot down.

Firstly, the majority is not always correct nor do they have the authority to interpret the Constitution of our United States.

Was Judge Walker biased? I think not.

"He was appointed by Ronald Reagan, but his nomination was held up for two years in part because of opposition from gay rights activists. As a lawyer, he helped the U.S. Olympic Committee sue a gay ex-Olympian who had created an athletic competition called the Gay Olympics."

I'm not advocating government intervention, but this is case where brainwashing by both sides of the debate played a significant role in the final outcome of Prop 8. In other words, I question just how much the people's opinions were their own.

Furthermore, I couldn't give a flying you-know-what about how we define marriage. As BZ stated, the words have meaning regardless of how they are defined. I do care, however, whether or not a proposition, regardless of how the people voted, was constitutionally illegitimate. Prop 8, no matter how it was intended, clearly segregated a population of AMERICAN citizens.
